TERMS

To receive your free "second fridge" removal and $35 cheque (if eligible), you will need to complete and comply with the terms set out in a form with this wording. The Terms Form will be sent to you. Please hand it to the removalist collecting your fridge. THE FORM CONTAINS THE FOLLOWING TERMS:

1. Fridge Buyback is currently only available in selected areas of Metropolitan Sydney.

By signing this form you warrant that:
1. the information you provided on this form is accurate.
2. the fridge you are transferring to Fridge Buyback is your property or you are authorised by the owner of the fridge to transfer it as their agent.
3. you have completed this form in relation to a residential property in NSW and met the NSW Greenhouse Gas Abatement Certificate requirements outlined below.
4. you are transferring rights to create NSW Greenhouse Gas Abatement Certificates to Fridge Buyback as an individual and not as part of any business, enterprise or any other type of organisation that you may carry on. For this reason you are not providing an Australian Business Number (ABN) to us.
5. you have emptied, unplugged and defrosted the fridge, drained any water from inside the fridge, freezer compartment and in any drip trays below the fridge and provided safe access to the authorised person collecting the fridge.
6. it is your responsibility to make their fridge accessible for the removalists to collect. If the removalists cannot access the fridge, a rebooking can be made but no $35 payment can be paid.
7. you acknowledge that, at their discretion, the authorised person collecting the fridge may decline to collect the fridge if they feel that conditions are unsafe, that removal may cause damage to property, that removal is infeasible or that the fridge is ineligible for the Fridge Buyback Program. In such a situation, you will not be eligible for the $35 payment and Fridge Buyback is under no obligation to remove the fridge.
8. you agree to the conditions set out in this form.
Fridge Buyback will pay $35 to qualifying participants where the removal involves 6 (six) or fewer interior and exterior stairs. If the removalists have to transport the fridge up and/or down between 7 (seven) and 20 (twenty) interior and exterior stairs to get the fridge to their truck, Fridge Buyback will collect the fridge free of charge but no $35 payment will be made. Fridges requiring transportation involving 21 (twenty-one) or more stairs will not involve a payment and will incur a fee which will be negotiated directly with the removalists prior to collection.

Upon Fridge Buyback having:
1. received confirmation from the removalist that your fridge has been collected;
2. received the completed paperwork from the removalist, including a copy of this form completed and signed by you; and
3. processed such paperwork,
Fridge Buyback will then pay $35 by cheque made out to the person whose name appears on this form. This should not take longer than 14 business days.

NSW Greenhouse Gas Abatement Certificates (NGACs)

For the purpose of the Greenhouse Gas Benchmark Rule (Demand Side Abatement) No 3 of 2003 (NSW) ("Rule"):

I nominate Fridge Buyback as the "Abator" in respect of the Fridge Buyback Program.

This nomination is effective to entitle Fridge Buyback to create and own all "Abatement Certificates" in respect of the Fridge Buyback Program, regardless of when the greenhouse gas abatement actually occurs.

I declare that I am entitled to make this nomination, because:

I am the person who is solely contractually liable (or otherwise liable if there is no contract) to pay for the energy consumed by the fridge collected as part of the Fridge Buyback Program at the time of signing this form; or
I make this nomination on behalf of all persons who are so liable
I have not (and any person on behalf of whom I make this nomination has not) previously made another nomination in respect of the Fridge Buyback Program for the fridge identified below that is still effective.

I certify that the fridge to be collected is:

10 or more years old;
250 litres or greater in gross volume; and
in working order, but not the main fridge, at the address listed.

Limit of Liability

You agree that, to the fullest extent permitted by law, Fridge Buyback (including its officers, employees, agents, contractors and volunteers) shall not be liable for any property damage or personal injury arising out of the collection of the fridge other than in the event of gross negligence or wilful misconduct on the part of Fridge Buyback.

Privacy Notice

Fridge Buyback is collecting personal information about you, including your name, address, and contact details for the purpose of administering the Fridge Buyback program. In addition, by signing this form you will be agreeing that we may pass your name and address on to the NSW Government for the purpose of the NSW Climate Change Fund and the NSW Greenhouse Gas Abatement Scheme. Your details will not be provided to any other party for marketing or other purposes, unless required by law.
